By accessing or browsing any of Captify’s webpages, including without limitation those published on captify.co.uk, captify.fr, captify.us, or any other Captify branded webpages or subdomains (collectively referred to as the “Site”), you agree to be bound by these terms.

These terms do not apply to provision or use of any of Captify’s advertising services or professional online portals or services, and you should refer to the specific terms and conditions applicable in each case.

You should also refer to Captify’s Privacy Notice and Cookie Notice which set out how Captify uses personal information and cookies in relation to your use of the Site or communications with Captify through the Site.

Captify may make changes to these terms due to developments in Captify’s business, technology, the law, or any other reasons. When visiting the Site you should check for the latest version.

1. About us

The Site is operated by Captify Technologies Limited, a company registered in England (Companies House registration number 11520330) with its registered office at 5 Langley Street, Covent Garden, London WC2H 9JA, United Kingdom and VAT registration number GB 114 2035 71. As used in these terms, Captify includes Captify Technologies Limited and all its group of companies and its and their staff, investors, and agents.

2. Site Content

2.1 All rights in the Site and all its contents, including trademarks, symbols and slogans, text, data, databases, code, still or moving images, audio-visual content, graphics, designs, and layout, whether or not registered, are owned by Captify or by Captify’s third party licensors. Third party trademarks may be used on the Site for identification purposes and are owned by those third parties.

2.2 You must not copy, adapt, publish, or re-use any element of the Site without Captify’s permission (except as necessary for normal website browsing). You must not remove, hide, modify or otherwise interfere with any copyright notices or attributions. You must not create any hypertext links, frames, or any other links between the Site and any other site without Captify’s written permission.

2.3 The Site contains information, news, and data that Captify believes may be of interest to visitors. However, all Site materials are provided for background information and general interest only and are not intended to be relied upon to make specific decisions. If you wish to obtain advertising or technical services or advice, then you should consult a Captify manager or other professional adviser who can advise specifically in relation to your objectives and circumstances.

2.4 From time to time the Site may include links to third party services, sites or applications. However, Captify is not responsible for any content, products, services, or advice that may be offered after following such links, any transaction you may enter into with or through any third party, or how any third party uses personal data.

3. Liability

3.1 To the maximum extent that the law permits, and subject to the provisions of section 3.2 below, Captify excludes all liability, whether for breach of contract, non-contractual liability or any other cause of action, for any error, omission, or for any other matter arising out of or in connection with your use or inability to use the Site. In particular, Captify will not be liable for:

  • any economic losses (e.g. loss of revenues, profits, contracts, business or anticipated savings);
  • any loss of goodwill or reputation;
  • damage to any device or digital content;
  • any indirect losses; or
  • any loss or damage arising due to any event outside Captify’s control.

3.2 Nothing in these terms shall exclude or limit Captify’s liability for death or personal injury resulting from Captify’s negligence, for fraud or fraudulent misrepresentation, or any for any other matter that may not be excluded or so limited under applicable law.

4. Warranties

Captify will use reasonable care and skill in providing the Site, but the Site is provided without any other representation, endorsement, or warranty of any kind. Any terms that would otherwise be implied by law, course of dealing, or custom are also excluded. For clarity, Captify excludes all warranties of non-infringement, satisfactory quality, fitness for a particular purpose, compatibility, accuracy, availability, or that the Site will be up to date or complete.

5. General

5.1 Captify operates in the field of advertising and technology services provided to other professionals and businesses. Captify’s services are not directed or provided to children or individuals acting outside of their trade, business, craft, or profession.

5.2 If any provision of these terms is or becomes illegal, invalid or unenforceable, that shall not affect the legality, validity or enforceability of the other provisions.

5.3 Any failure or delay by Captify to exercise any right or enforce any provision of these terms shall not operate as acceptance of any breach, or a waiver of that (or any other) right or provision.

5.4 Subject to any other specific terms applicable to Captify’s services, these terms constitute the entire agreement between you and Captify for use of the Site, and override any other discussions, documents, and anything else indicated on the Site, by telephone or email, or in any other way.

5.5 Captify may at any time assign or transfer any of Captify’s rights or obligations under these terms to any other party, and in particular to a buyer of Captify’s business, a business that Captify merges with, or to another company in Captify’s group of companies.

5.6 Use of the Site, these terms, and your interactions with us are governed by English law. To resolve any contractual or non-contractual dispute between you and Captify, we both submit to the exclusive jurisdiction of the English courts.
