Sense Privacy Notice and Cookies Policy

This Notice sets out what data we process in relation to the Sense service, how we use it, where it goes, and your rights to decide what happens with it. We will use personal data about you only for the reasons that you provided it, and in accordance with all applicable laws and this Notice. 

We may change this Notice from time to time, for example because of developments in technology, our business, or the law, and the new version will be posted here.

1. Who is the data controller for your data?

2. Why do we process personal data? What data do we process? And what is our legal basis for that processing?

You are required to have a valid account in order to use Sense, which means that we will process your data as set out in this Notice, for the following purposes:

  • Creating and managing your Sense account: In order to use your Sense account you need to provide data such as your name, organisation, authorised user email, and phone number.

You can edit this data by logging into your account. 

  • Providing customer service: if you contact us with a query or support issue, then we will collect and process your details and keep records of our interactions with you (e.g. calls, emails, chat sessions), as needed to investigate and provide you with an answer.
  • Service communications: we may need to contact you in relation to forgotten account details, technical issues with the service, updates to terms and conditions, or other non-promotional service-related matters.
  • Sending newsletters/offers: as a corporate user, we may sometimes send newsletters or other offers or information and we’ll use your data to tailor and send these to you.
  • Business development: we may use the queries you input (e.g. key phrases) and data on how you use Sense in order to identify opportunities for offering other Captify products and services to your organisation.
  • Improving Sense: we’ll analyse which pages or parts of the service get the most views or usage, so that we can improve. This may also include collecting details about the queries you input, and your device and network, such as browser version, IP addresses, operating system details, and screen size. This may also involve the use of cookies or similar technologies as explained in our Cookies Policy at the end of this Notice. 

Our legal basis for these data uses is that they are necessary for our legitimate interests in ensuring that Sense users get good service, understanding how Sense is used, Captify business development, and improving our products and services for the future. We only use this data for the above purposes. It’s used securely, and not in any intrusive way. This data relates only to your work life and no private data is required. There is no negative impact on your privacy or rights and so we have concluded that we are able to process this data to support our legitimate interests in these ways.

3. How long does Sense keep your data for?

Sense doesn’t keep your personal data longer than necessary, which is normally for the time that your account is active or the Services Agreement with your organisation is live. 

If we need to keep your data longer e.g. for tax, accounting, reporting or legal reasons, then we will use it only for those purposes and for a period that is reasonably necessary to comply with our obligations and to be in a position to deal with any legal claims.

After these periods we anonymise data (so it does not contain any personal information and cannot be traced back to you) but may keep and use it for research or statistical purposes and improving our services.

4. Does Sense provide your personal data to any third parties?

In order to provide Sense and all its functionalities, we work with other organisations that provide services such as IT and data processing, or other professional advisors. These include:

  • providers of IT-related services (e.g. data storage, service development, hosting, management, or maintenance);
  • companies in our group that provide us with technical infrastructure or services;
  • data analysis providers (e.g. measuring which webpages or product features are of most interest); or
  • accounting, legal, insurance or payment service providers.

These organisations process personal data on our behalf, but we require them to meet data protection standards as strict as the ones that apply to us, and not to use your data for any other purpose.

Where these are not based in the UK, the EU, or other countries that are officially regarded as having adequate data protection laws, then this will be done only on the basis of legal safeguards aimed at ensuring that your data is kept as secure as under applicable UK and international laws. These may include standard contractual clauses for data exports approved by the European Commission or national supervisory authorities. A copy of such safeguards may be available from us if we receive a valid request.

Other circumstances where we may need to disclose your personal data to third parties could be (i) where required by law, stock exchange rules, or any governmental authority, police force, court or regulator; or (ii) in connection with a sale or merger of our business or company.

5. What are your rights in relation to your personal data?

Under UK and international laws that apply to us, you have various legal rights in relation to your personal data. For example, you are entitled to ask at any time:

(a) for access to a copy of the personal data that we hold about you;

(b) to have any incorrect personal data about you corrected;

(c) for data about you to be erased (also referred to as the “right to be forgotten”) or to have processing restricted:

(d) to object to particular processing; and

(e) to receive an electronic copy of data you provided to us, for provision to a different service provider (also referred to as “data portability”).

You are also able to withdraw any consent given in the past (although any data processing that took place based on such consent before it was withdrawn will still be legal).

We can always be contacted at the addresses in Section 1 to resolve any issues or doubts you may have in relation to processing of your data, or exercising your legal rights. If you believe that your rights have not been respected, then you are also entitled to complain to the UK Information Commissioner (www.ico.org.uk), or the supervisory authority in your country, to ask them for a decision.

Cookies Policy

Sense uses ‘cookies’ that store information to help us understand the use of our services and to make them easier to use. This policy is designed to tell you about the cookies we use on our service.

A cookie is a small file that our service may place on your device and which can be useful for recognising you as a returning visitor, saving settings and providing us with information about how the service is used. Some cookies are required so the site can work but other than those, you are not obliged to accept cookies, and you have the ability to accept, decline or delete cookies using the settings in your web browser.

Sense uses the following types of cookies:]

“Essential cookies” – these are needed in order to enable you to move around the service and use all its features. Without these cookies, some features cannot be provided – for example, remembering previous actions or saved items, or keeping you logged in while browsing, or permitting communications through the service (e.g. online chat).

“Analytical or Performance cookies” – these gather information about how Sense is used, for example, how many users visit different pages, how long they spend there, or the items they click on. These cookies are only used to monitor, test, and improve ease and speed of navigation, and analysing how the service is used.

“Functional cookies” – These are used to recognise you when you return to our service.  They enable information you enter to be saved for your next visit (such as your username or country settings), so that you don’t need to re-enter it and any personalised features are remembered.

To use Sense, you will normally need to have cookies enabled on your browser and device. If cookies aren’t enabled, then your browsing experience may be limited and you may not be able to use certain sections, such as your account, saving items, or communicating with us, in the ways they were designed. If you clear cookies or change devices then you may be asked again for your consent to use cookies as explained in this policy.
